Here's my list . . .


  1. My property is located in a Historic District so I'm told it must meet simplified design standards. Is there a document that defines "simplified design standards?" And who makes the call on if the design is simplified or not?

  2. Setbacks: This is not clearly spelled out since I’m trying to use my existing garage which was built in 1910 right on the side and rear property lines.

  3. The fire department says they need a 3 ft clearance around all sides of the ADU but others have said that if you don’t increase the size of your building the old setbacks stay. I would like a definitive answer and be directed to the documentation since I'm unable to find it on the City's ADU portal.

  4. I'd like clarification on the visibility of the address. The ADU will be located in the rear yard behind a gate for security purposes. Where should the address be displayed to meet code?

  5. This question relates back to question 2 (setbacks) and is question 17 on the ADU Universal Checklist. ADU Access. Is the distance from the street curb of the lot to all portions of the proposed ADU no greater than 200 feet as measured along a minimum 3-foot clear path to all sides of the ADU?

  6. The solar requirement, if I put it on my house will that meet the code so I don't have to put it on my ADU?

  7. My side neighbor's backyard has been raised with dirt piled against my garage to a height of xx inches. It's been that way since I moved in 30 years ago. I'm wondering how to address this from a foundation perspective. Show Pic.

  8. Given the state of the garage, if I tear it down and rebuild it keeping the same footprint and size, what are the setbacks?

  9. Permit Cost Estimate Form: Project Type? I need to bring Form #337 and go over it with the City Planner

  10. Does the city have a list of ADU recommended architects and engineers?

  11. What books/documents should I get to better understand the codes and zoning regulations in CA and San Jose?


I was told to go to City Hall early but NOT on ADU Tuesday’s which are geared towards express plan review and permit approval. So I think I will go on a Monday or Wednesday in the coming weeks.
